MY HOUSE YOUR SHOOT is an internet based service which gives home owners the opportunity to make their properties available for use in connection with media projects (including film, television, commercials, photographic shoots, music videos, internet virals and other events) and for potential clients to search for and identify which of those properties is appropriate for them (the Service ).

Please read the following terms and conditions carefully before using the Service, so that you are aware of your legal rights and your obligations to JJ Locations Limited (MHYS).

By registering to use the Service (either as, or on behalf of, a property owner or as a prospective client) you signify your irrevocable acceptance of these terms and conditions.

We reserve the right to change, modify, suspend or discontinue any portion of the Service at any time provided we give you reasonable notice of the changes.

We reserve the right to change these terms and conditions from time to time by posting revised terms and conditions on this Service. Although we may notify you of the existence of revised terms and conditions, you are encouraged to review the applicable terms and conditions from time to time. Revisions to these terms and conditions will be effective once they are posted on the Service. Your continued use of the Service following the posting of any changes will mean that you accept to be bound by them. If you do not wish to be bound by these terms and conditions (or any revised terms and conditions) you are not authorised to access or otherwise use the Service and you must discontinue your use of the Service immediately.

1. Membership / Accessing the Service
1.1 Access to the Service is limited to its members. You will only become a member of the Service when you have completed our online registration process and we have provided you with your own unique username and password for your account, but there is no fee payable for membership unless you, as a Property Representative (as defined in paragraph 2.1 below), opt for a featured listing in accordance with paragraph 2.3 below.
1.2 Your access to and use of the Service is subject to these terms and conditions at all times. Unless you are accessing the Service in your personal and individual capacity you do so as the representative of the company or other entity that employs you or engages your services, and you represent and warrant that the relevant entity is bound by these terms and conditions.
1.3 The use of your unique username and password is limited to you and other authorised representatives. If any other person wishes to access or use the Service that person must complete our registration process.
1.4 You will be responsible for maintaining the security and confidentiality of your username, password and your account information, and you are fully responsible for all activities that occur under your account (including any unauthorised access or use of the Service under your account).
1.5 You agree to immediately notify MHYS of any unauthorised use of your account or any other breach of security and to ensure that you exit securely from your account at the end of each session.
1.6 MHYS will not be responsible or liable for any loss or damage arising from your failure to comply with the requirements of this paragraph 1.
2. Use of the Service
2.1 As a member of this Service you will be able to upload details (including images) of a property that you own or are legally authorised to represent (Property Details) for inclusion on the Service (and will be regarded as a Property Representative for the purposes of these terms and conditions), and by uploading such Property Details you, as a Property Representative, hereby represent and warrant that: (a) you are either the lawful owner (if you have uploaded Property Details on the basis that you own the property concerned), or a legally authorised representative of the property owner (if you have uploaded Property Details which relate to a property which is not owned by you); and (b) you have no knowledge of any reason why you may not be entitled to upload Property Details to the Service. When you as a member of the Service use the Service other than as a Property Representative (i.e. when you are using the Service for the purposes of browsing for suitable properties for you to use as a location for your film, TV programme, TV commercial or photographic shoot) you agree only to access the Service in order to fulfil that purpose and for no other purpose whatsoever (and will be regarded as an Ordinary User for the purposes of these terms and conditions).
2.2 The Property Details that you, as a Property Representative, input shall be in line with any guidelines we may issue regarding the use of the Service from time to time. You acknowledge and agree that depending on the level of membership you have signed up to the amount of data and level of Property Details that you may include will be limited in accordance with the level of membership described on the Service at the point at which you sign up.
2.3 In consideration of the payment of applicable fees, if you, as a Property Representative, opt for a featured listing you will be provided with additional benefits (which will be as described at the point at which you sign-up for such a listing) over and above those made available to members who use the Service on a free-basis. For the avoidance of doubt, the additional benefits you are provided with as part of a featured listing may include documentation which is made available to assist you in the process associated with the transaction you may enter into with an Ordinary User. Without prejudice to paragraph 8, to the extent that any template documents are provided as part of the featured listing you hereby acknowledge and agree that those documents are only provided as a guide and you should take advice from your professional advisors on whether the template concerned is appropriate for your particular transaction.
2.4 You acknowledge that MHYS may discontinue certain elements of the Service where it deems appropriate, provided we give you reasonable notice of the discontinuation.
3. Details provided by Property Representatives
3.1 You, as a Property Representative, will be solely responsible for the accuracy, completeness and reliability of the Property Details you provide for inclusion on the Service. By submitting Property Details that are inaccurate, incomplete or unreliable, you will be undermining the overall accuracy, completeness and reliability of the Service, and you may be liable for making a misrepresentation to Ordinary Users as to the nature of your property. MHYS shall not be responsible for any decision made by a Property Representative to allow any Ordinary User to access or use the Property Representative's property.
3.2 As an Ordinary User, you acknowledge and agree that nothing done by MHYS in making the Service available will in any way be deemed to be a representation, warranty or undertaking on the part of MHYS of any sort as to the accuracy, completeness and reliability of the Property Details supplied by other Property Representatives. MHYS shall not be responsible for any use or decisions made by Ordinary Users based on the Property Details included by Property Representatives on the Service, and Ordinary Users are advised to carry out such checks as they may reasonably deem necessary in order to satisfy themselves as to the nature of the property concerned before entering into any agreement with a Property Representative in respect of the access to and use of that property.
3.3 Any arrangements regarding access to and use of a Property Representative's property shall be governed by such terms and conditions as the Property Representative and the relevant Ordinary User may agree, and for the avoidance of doubt MHYS shall play no part in the direct discussions and/or negotiations between the Property Representative and an Ordinary User, and shall not be a party to any agreement between the Property Representative and the relevant Ordinary Use (unless expressly agreed with MHYS in advance under a separate representation agreement).
3.4 As a Property Representative, you will be responsible for ensuring that:
3.4.1 you have all necessary legal consents, licences and permissions required to input Property Details relating to the property concerned on the Service and to enable MHYS to include those Property Details on the Service for viewing by Ordinary Users; and
3.4.2 for the avoidance of doubt, you will comply with all relevant representations and warranties under paragraph 4 below in respect of the details you input relating to your property.
3.5 We shall only use and process the Property Details provided by you, as a Property Representative, for the purposes of providing the Service (including for the purposes of promoting the availability of the Service to third parties).
4. User conduct
4.1 You represent and warrant that you will not:

4.1.4 impersonate any person or entity or misrepresent your affiliation with any other person or entity;
4.1.5 engage in spamming, flooding, harvesting of e-mail addresses or other personal information, spidering, screen scraping, database scraping, or any other activity with the purpose of obtaining lists of users or other information (including any activity which involves accessing or using cookies for purposes which are unrelated to the Service);
4.1.6 use the Service or the Property Details (or any other information) obtained from or via the Service to operate a service bureau or other revenue-generating service business;
4.1.7 attempt to gain unauthorised access to other computer systems through the Service or obtain (or attempt to obtain) any materials or information through any means not intentionally made available or provided for on the Service;
4.1.8 reverse engineer or decompile, disassemble or otherwise reduce any machine-readable part of the Service or component thereof to human-readable form;
4.1.9 create or attempt to create, by reverse engineering or otherwise, the source code or internal structure of the Service (or any part thereof);
4.1.10 remove any product identification, legend or notices of any proprietary or copyright restrictions from any part of the Service;
4.1.11 list or otherwise display or copy any object code underlying the Service (or any part thereof);
4.1.12 copy the Service or any Report, develop any improvement, modification or derivative works or include any part thereof in any other computer program, equipment or item save as specifically permitted under these terms and conditions or as specifically allowed by applicable law; or
4.1.13 represent or claim that you are the owner of any of the software underlying the Service or otherwise do anything that is inconsistent with MHYS's proprietary rights.
4.2 If you breach or fail to comply with any of the representations and warranties set out in paragraph 4.1 above, MHYS shall be entitled to:
4.2.1 immediately suspend your access to and membership of the Service; and/or
4.2.2 immediately terminate your access to and membership of the Service.

5.1 As between you and MHYS, MHYS will continue to own all intellectual property rights relating to the Service (including the look and feel, design and organisation thereof) and any documentation made available to you in connection with the Service (Documentation).
5.2 Your use of the Service and/or any Documentation (whether during the term of this agreement or after its termination) shall be restricted to your own internal business purposes only. If you wish to use the Service and/or the Documentation for any external purposes (including marketing or other commercial purposes) you shall first obtain the prior written consent of MHYS (which shall be subject to such terms as the parties may agree and which MHYS may regard as appropriate given the nature of the use proposed).

7.3 Termination or suspension pursuant to paragraphs 7.1, 7.2 and 4.2 shall not affect any other rights, remedies or other forms of relief to which MHYS may be entitled, at law or in equity.
8. Limitation of Liability / Disclaimers
8.1 IN NO EVENT WILL MHYS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSSES OR FOR EXEMPLARY DAMAGES OR FOR ANY DIRECT OR INDIRECT LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER SUCH LOSSES, INCLUDING WITHOUT LIMITATION ANY SUCH LOSS OR DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH: (1) THE USE OF THE SERVICE OR ANY DELAY OR INABILITY TO USE THE SERVICE, OR (2) ANY INFORMATION, MATERIALS, DATA OR SERVICES PROVIDED OR OBTAINED VIA THE SERVICE (INCLUDING IN RESPECT OF THEIR ACCURACY, SUITABILITY, COMPLETENESS OR LEGALITY), OR (3) THE USE BY OTHER USERS OF THE SERVICE, OR (4) MHYS'S DISCONTINUATION OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, AND EVEN IF MHYS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES.
